Our privacy policy is a statement that describes how our website collects, uses, and manages the personal data of customers or potential customers. 

In this Privacy Policy (“Privacy Policy”):

  • Numerex is collectively and individually referred to as "Numerex", "we", "our", or "us". 

  • Customers, subscribers, site visitors, and registered users are collectively and individually referred to as "you" or "your".

  • Our website refers to www.numerex.com.au and any subdomains that we own ("Website")

Numerex is based in the Australian Capital Territory, Australia.  We are committed to protecting your privacy and respecting and upholding your rights when you use our site. This Privacy Policy applies to the products and/or services we provide on our Website and explains how we collect, hold, use, and disclose your personal information.

 

This Privacy Policy is not intended to override the terms of any contract you have with us, nor any rights you may have under other applicable data privacy laws that apply in Australia. This Privacy Policy does not cover information that you submit on other websites or social media channels, even if we communicate with you on those sites. Those sites are governed by the privacy policies on those websites and social media channels and not governed by this Privacy Policy.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act) to the extent applicable. The APPs govern how we collect, use, disclose, store, secure, and dispose of your personal information. You can obtain a copy of the Australian Privacy Principles from the website of The Office of the Australian Information Commissioner at www.oaic.gov.au.

Before accessing or using our products and/or services:

  • Read this Privacy Policy, Terms of Use, and Terms of Service

  • If you provide us with any data relating to a third party, you confirm that you have the right to authorise us to process that data on your behalf under our Privacy Policy and Terms of Service

  • If you read and fully understand our Privacy Policy, Terms of Use, and Terms of Service and remain opposed to our practices, you must immediately leave and discontinue your association with us until such time that you are no longer opposed.

Our responsibilities

We are the providers of the products and/or services on our Website and we determine how and why your data is processed. We will not sell or rent your details to any third parties. We will not knowingly collect any personal information except what you have provided to us or authorised a third party to provide it to us on your behalf.

What is personal information?

Personal Information is information or an opinion that identifies an individual or an individual who can be reasonably identified from that information.

  • For a secondary purpose that is directly related to the primary purpose

  • With your consent; or where required or authorised by law.

We will not ask you to disclose sensitive information. If you provide sensitive information it will also be captured and stored.

What type of data we may collect

  • data on how you use our Website (such as URL clicks, how long you are on our pages, and other actions)

We collect data from the moment you visit our Website, contact us in other ways, or provide a third party with the authority to provide us with your information. Examples of collection methods are:

We don’t guarantee website links or the policy of authorised third parties.

We collect your personal information for the primary purpose of providing our services to you and to allow us to improve our services to you. We may also use your personal information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. Examples of why we collect are:

  • An individual’s Tax File Number, if they choose to provide it, by the Income Tax Assessment Act 1936 (Cth)

  • fraud bureaus or government agencies or departments to identify, investigate, or prevent fraud or other misconduct

  • regulatory bodies, government agencies, and law enforcement bodies in any jurisdiction

  • third parties where you consent to the use or disclosure

  • third parties to enable us to provide our products and services to you

  • all other areas otherwise permitted to disclose the information under the Privacy Act

  • if we ever sold our business, we may need to transfer data to the new owner

Do you hold credit cards or other payment details?

If and when we collect credit card or other payment details, we will not store them. Card details will be passed directly via a secure encrypted SSL connection directly to the bank's payment gateway.

Do we disclose your personal information overseas?

We may disclose your personal information to a recipient who is located outside of Australia only when deemed necessary or required under law. This may include:

  • any financial institution that you have an account with overseas and have provided us with permission to make enquiries etc on your behalf

  • any data hosting and IT service providers where the provider has encrypted data backup up or mirrored in overseas jurisdictions  

  • other third-party providers

Do you use or disclose personal information for marketing?

We may use your personal information to offer products and services to you if we believe they may be of interest, but will not do so if you tell us in writing not to do so. These offers for products and services come in various forms such as mail, telephone, email, SMS, or other electronic means such as our social media sites or website. We may also disclose personal information to external parties who assist us in marketing our products and services such as a mailing house.

Security of personal information 

Our customers trust us to protect their data, and whilst we cannot guarantee the security of any information you transmit to us, or receive from us, we take that task very seriously. Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and unauthorized access, modification, or disclosure. This includes:

  • password access to accounts

  • storing electronic data with reputable third-party storage providers who have appropriate security protections and policies

  • limiting access to personal information only to individuals who need to know

  • using payment providers who are PCI DSS compliant

  • not storing your payment details

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years to comply with various legislation that we are required to adhere to in Australia.

Online payment security

Where payments are taken online, all of our real-time credit card authorisations are handled by secure third-party gateway providers and these are secured by the highest level of security. The following measures are taken to protect your data:

  • Payments are fully automated with an immediate response.

  • Your complete credit card number cannot be viewed by us or any outside party.

  • All transaction data is encrypted for storage within our third-party gateway suppliers' bank-grade data center.

  • Our third-party gateway provider is an authorised third-party processor for all the major Australian banks.

  • Our third-party gateway provider will at no time touch your funds, all monies are directly transferred from your credit card to the merchant account held by us.

We use third-party gateway providers that are widely respected for providing secure and reliable online payment solutions. While we attempt to protect the information in our possession, no security system is perfect, and we cannot promise that information about you will remain secure in all circumstances.

The Payment Card Industry Data Security Standard (PCI DSS) is an information security standard for all organisations that handle branded credit cards from major card schemes. PCI DSS is a standard mandated by card brands like Visa, Mastercard, American Express, and Discover and is managed by the PCI Security Standards Council.

PCI-DSS requirements help ensure the secure handling of credit card information through our website and the service providers.

Access to your Personal Information

Under the Privacy Act, individuals have the right to seek access to information that we may hold about them, subject to certain exceptions. Individuals also have the right to ask us to correct information about them that may be inaccurate, incomplete, or out of date. 

 

If you wish to access your Personal Information, please contact us in writing. Numerex will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information. To protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the quality of your personal information 

It is important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete, and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Notification of data breaches

Due to the Privacy Amendment (Notifiable Data Breaches) Act 2017, Numerex is legally required to notify affected individuals of any eligible data breaches. To comply with this legal requirement, we have implemented a Data Breach Response Plan to deal with actual or potential data breaches as well as the notification process to be followed when notifying affected individuals.

Privacy policy complaints and enquiries 

If you have any queries or complaints about our Privacy Policy please contact us in writing. We will endeavor to respond to you within 14 business days unless it is unreasonable to do so. If you are not satisfied with our response to your complaint you may seek a review by contacting the Office of the Australian Information Commissioner using the information available on their website at www.oaic.gov.au/privacy/privacy-complaints

This Policy may change from time to time to reflect, for example, changes to our practices, or other operational, legal, or regulatory reasons. The current date of the privacy policy also known as the "effective date" is prominently displayed at the very top of this Privacy Policy.
